The Bush Amendment PDF Print E-mail
Written by Adam

Resolved by the Senate and House of Representatives of The United States of America in Congress Assembled(two-thirds of each House concurring therein), that the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as a part of the Constitution when ratified by the legislatures of three-fourth of the several States within ten years after the date of its submission for ratification:

No presidential appointment to a vacancy during the recess of the Senate shall be valid for longer than ninety days, unless it has been approved by the requisite number of Senators duly chosen and sworn.

To be valid, any pardon or commutation of the sentence of a member or former member of the executive branch of the United States of America for a crime committed while in office must be approved by two-thirds of the Senators Duly chosen and sworn before it shall become effective.

Any takers?

Any additions?

No auto-pardoning
There just plain needs to be an anti-corruption amendment to prevent sitting presidents from pardoning themselves and staff.

How about anyone pardoned and any member of their family can not have given political contributions in the past to a Presidential candiates during their campaing for office or for their upcoming Presidential Library (i.e. Mark Rich (sp). No one who has left the country after their conviction cannot be pardoned.

Be careful of what you wish for.

Don't play politics with our Constitution.
Never pass, and it shouldn't.

Better to spend your time trying to get Franken selected for Senator.

Quiz time, why did Bush and Clinton find it necessary to make recess appointments? Answer, too many people playing too much politics, not enough statesmen and women. Elections have consequences, Obama should get his appointments, as Bush and Clinton should have got theirs.

Truth, you're not going to get me to defend Clinton's pardon of his brother or of Mark Rich. They were reprehensible. I would consider immediate family members of the President and maybe the Vice President but I wouldn't get much farther, otherwise it would get far too messy. There is a point at which we must trust the President to exercise good judgement as it relates to clemency, but that power has been abused by both Clinton and Bush and should be curtailed.

Now, S. Fred Wood, as it relates to recess appointments, this is one of those areas that would not look the way it does if the founders had a concept of modern technology. The recess appointment allowed for the president to fill an office on an interim basis so that he didn't have to call a special session every time a member of the cabinet died. Since the congress did not meet year-round and it took a long time for members of Congress to travel to and from their district, this made sense. Nowadays the longest recess of congress is over August. Otherwise they meet year-round.

These presidential powers have been abused by several presidents, most notably by Bush, but Clinton as well, also H.W. Bush, and Reagan...and ought to be curtailed to try to restore the balance of power. The power of the executive branch has been expanded to a point that the founders would be in shock over. This would begin the restoration of that.

If you want to argue that the Senate should just bend over and take every nomination that is handed to them, I don't think that's what the founders had in mind when the created the idea of advice and consent. It was designed to act as a check on the president's appointment power. It is being abused. It should be fixed.

Plain and simple.

So if the Clinton ones were reprehensible why name it the Bush Amendment? Why no mention of Clintons abuse of the pardons as well? If I hadn't shown the hypocricy of your post, you never would have mentioned Clinton. Its for the pure partisians like yourself that this country is divided. Partisians seems to forget that their side is just as bad until its pointed out then they try to cover.

Because this amendment doesn't deal with that...
This amendment deals with George Bush's abuses of the pardon power. Clinton didn't pardon his staffers for covering his butt. He pardoned his brother and he pardoned a political contributer.

And by the way, I am not a pure partisan, the democrats can screw up just as much as the Republicans. I was actually hoping Obama would appoint a Republican Attorney General like Arlan Specter that would hold him accountable(although I wouldn't have liked Ed Rendell to appoint his successor). What I cannot stand is neoconservativism, which seems to pervade the Republican party and drive out all other moderates (like Jim Ramstad for example).

I am a liberal and I cheer on liberal candidates, but I do believe in hearing all sides to an argument, because my perspective may not always be the right answer to the problem.

Oh, and its spelled "hypocrisy."

Don't forget that Clinton also pardoned terrorists just so his wife could get their nationalities vote in her Senate seat. I also call that an abuse of the pardon.

Funny that you know how to spell the word but don't see how many times it applies to your postings or maybe you do and you just hope others won't point out the obvious.
