Federal Judge Allows Electioneering on Election Day PDF Print E-mail
Written by Chet

Here's the judge's Order:

Emineth v. Jaeger

I don't have a really strong opinion on this.  I can see both sides.  On the one hand, I dread the idea of having to suffer through one more day of political advertising.  On the other hand, we kinda do have a first amendment.

Even in North Dakota.

Those ND Republicans, whining to the federal courts when they can't get their way in the ND legislature.

So then I should respond in saying, "Those ND Democrats, they whine when the first amendment is used. It's the only way they can keep real information out of the voters hands."

Like Chet said...it's a First Amendment issue. I also agree that I dread hearing it for one more day...but the law should have never been passed anyways. It was never Legal.

The real issue
The law has never been a real impediment to campaigning on election day. Since the law was so clearly unconstitutional and has never been enforced, it was the likely negative public reaction to campaigning on election day that has prevented candidates from doing it. I imagine the end of the law will, however, immediately open up one more day of advertising for any campaign that still has a few dollars left.

Jason - my sarcasm did not come across in print. Sour grapes on my part -- I wanted to litigate the issue as an affirmative defense, but the local gendarmes never cited me for leaving my yard signs up on election day.

In this entire election cycle, we have been exposed to a one sided insanity that is reflected here with the one line from Jason. My wife and I watched "inherit the wind" the other night and I would suggest that you all rent it and reflect as to whether or not we are more nuts here in ND today than they were in Tennessee in 1925. Both of us agreed that we are way more nuts now.

We have surrendered the country to the elites with their army of Jasons doing their dirty work. NO THINKING ALLOWED!!!!!!!!!

I hope this doesn't go the way of other states. When I lived in Missouri, campaigning was prohibited within a certain distance from the polling location. Getting from your car to the outer edge of the campaign-free perimeter was like running a guantlet with people jostling to hand you literature and the like. I hated it!!
